On 8th July 2021, the Supreme Court began hearing the case of the family of the person who died as a result of the disaster that occurred on June 13, 2015.
As it is known to the public, the Tbilisi Court of Appeals shared the plaintiffs' arguments and fully satisfied their claims for pecuniary and non-pecuniary damage. The court found that the Ministry of Internal Affairs, the Patrol Police Department, the Emergency Management Agency, and the National Environmental Agency failed to fulfill their statutory obligation to protect the lives and health of citizens in the event of a natural disaster that resulted in the death of a person. The court clarified that the state had failed to take preventive measures properly and found that it failed to avoid the dire consequences due to the uncoordinated actions of the relevant agencies during the disaster.
The Judgment of the Court of Appeals was appealed by the respondent administrative bodies in cassation, and today their cassation appeals are considered by the court in an oral hearing.
GYLA has been representing the interests of the family members of the deceased since 2015. The next hearing in the case will be held on September 9, 2021.
